Terms of Service
Last updated: July 1, 2026
1. Acceptance
By creating an account or using BidCommand ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms form a binding agreement between you and FocusFlow Digital LLC, doing business as Coach Kay Elevates ("we," "us"), which operates BidCommand.
2. Description of service
BidCommand is a government contracting and proposal management platform. We aggregate publicly available bid and RFP data, provide tools to manage your pipeline and company profile, and use AI to help draft proposals. The Service is provided "as is" and we do not guarantee the accuracy or completeness of bid data sourced from third-party feeds.
3. AI output disclaimer
AI-generated proposal drafts, compliance summaries, and coaching responses are provided as starting points only. They are not legal advice, regulatory guidance, or certified compliance opinions. You are solely responsible for reviewing AI outputs before submission, ensuring regulatory compliance, and the accuracy of any bid or proposal you submit. BidCommand is not liable for outcomes resulting from use of AI-generated content.
4. Subscriptions and payment
Paid plans are billed monthly via Stripe. Your subscription renews automatically unless cancelled before the renewal date.
Free trial: Your first Starter or Pro subscription starts with a 14-day free trial. No card is needed to start. If you add a payment method, you will be charged the plan rate when the trial ends unless you cancel first. If you have not added a payment method, your plan ends when the trial does and nothing is charged. The Agent Add-on is not part of the free trial and is billed from the day you add it.
Refunds: We offer a 14-day money-back guarantee on the first billing cycle. After that, subscriptions are non-refundable. Contact hello@coachkayelevates.org for refund requests.
5. Acceptable use
You may not use BidCommand to:
- Scrape, resell, or redistribute bid data to third parties
- Submit false or fraudulent government bids
- Violate any applicable law or government regulation
- Reverse engineer or copy the platform
- Attempt to access data belonging to other organizations
6. Intellectual property
You retain ownership of your company data, capabilities statements, and proposal content. You grant BidCommand a limited license to process your data to provide the Service. BidCommand retains ownership of the platform, AI models, and all original software.
7. Limitation of liability
To the maximum extent permitted by law, BidCommand is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost bids, lost revenue, or regulatory penalties. Our total liability to you shall not exceed the fees you paid in the prior 12 months.
8. Termination
You may cancel your account at any time from Settings. We may suspend or terminate accounts that violate these terms. Upon termination, your access to the Service ends and we may delete your data per our Privacy Policy.
9. Governing law and disputes
These terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration, except for claims that qualify for small claims court. You waive the right to participate in class action lawsuits.
10. Changes to terms
We may update these terms. We will notify you by email at least 14 days before material changes take effect. Continued use after that date constitutes acceptance.
